Welcome to Carland Cartography. By accessing this website or purchasing any products from our shop, you agree to the following Terms & Conditions. Please read them carefully before making a purchase. 

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

1. Overview

This website is operated by Shopify doing business as Carland Cartography LLC. Our store is hosted on the web platform designed by Shopify. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. 

Throughout the site, the terms “we,” “us,” and “our” refer to Carland Cartography. By visiting our site and/or purchasing from us, you engage in our service and agree to be bound by these Terms & Conditions, including any additional policies referenced herein. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

By making a purchase from this website, you agree to hold harmless Carland Cartography, its affiliated companies, members, officers, employees, agents, or their service providers to be liable for any damages (whether consequential, direct, incidental, indirect, punitive, special, or otherwise) arising out of, or in any way connected with Carland Cartography.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse service to anyone for any reason at any time.

2. Digital Products & Delivery

Many of the products sold on this website are digital downloads, unless otherwise explicitly stated.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Refund Policy. You agree that you have read, understood, and agree to our Refund Policy. 

We have made every effort to display as accurately as possible the colors and images of our products that appear online. We cannot guarantee that your computer monitor's display of any color will be accurate. Carland Cartography is not responsible for print quality, color differences, or incorrect scaling of the artwork file once it has been purchased by the customer. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Upon successful payment, you will receive access to your digital files via email and/or your customer account. Delivery is typically immediate but may take a few minutes depending on payment processing.

No physical items are shipped for digital products.

3. License & Usage Rights 

All artwork sold through Carland Cartography is protected by copyright law.

Unless otherwise stated on the product page, your purchase grants a limited, non-exclusive, non-transferable license. When purchasing a digital file through Carland Cartography no ownership of the image is ever transferred onto the customer. Copyright always remains with Carland Cartography and usage of any product purchased is limited to what is stated in the product page and/or licensing agreement. All artwork remains the intellectual property of Carland Cartography. Purchase grants a limited, non-transferable license for one-time use only unless otherwise stated. You are not purchasing ownership or copyright of the artwork. All rights remain exclusively with Carland Cartography.

4. Prohibited Uses 

Without a separate written licensing agreement, you may not:

  • Use the artwork for hospitality or multi-property display

  • Resell, sublicense, share, or redistribute the files

  • Upload artwork to stock platforms, print-on-demand sites, or marketplaces

  • Create derivative works or modify artwork for resale

  • Use artwork in branding, marketing, advertising, or promotional materials

  • Use artwork for NFTs, blockchain, AI training, scraping, or dataset creation

You may not copy, display, distribute, transfer, link to, reproduce, license, frame, alter, create derivative works of, or republish all or any portion of the Site, the Site content, or any other materials received from or originating from Carland Cartography for any purpose without our prior written consent.

5. Hospitality & Multi-Property Use

Hospitality, multi-property or public installations require a separate licensing agreement and are not included with personal-use digital downloads.

Licensing options for hospitality use are available through our Artwork Licensing offerings or by inquiry.

6. Refunds & Exchanges

Due to the digital nature of our products, all sales are final.

We do not offer refunds, returns, or exchanges once files have been delivered or downloaded.

Exceptions may be made at our discretion for:

  • Duplicate purchases

  • Corrupted or inaccessible files

Please contact us within 7 days of purchase if you experience technical issues.

7. Billing & Account Information

We only sell to customers located within the United States of America (USA) and reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors unless appropriate wholesale order requirements are met.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

8. File Access & Storage

Customers are responsible for downloading, storing, and backing up purchased files. Only one download is permitted per purchase. We recommend saving files in multiple secure locations.

We are not obligated to provide replacement files if download access expires or files are lost.

9. Products & Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

10. Intellectual Property

All content on this website—including artwork, images, text, and designs—is the exclusive property of Carland Cartography and may not be copied, reproduced, or used without permission.

All of the images and content on the Site are owned and controlled by Carland Cartography, except as otherwise expressly stated, and are protected by U.S. copyright laws and international treaties. The copyrighted materials on the Site include, but are not limited to, the text, design, software, images, graphics, source code, and the content on the Site. You may not copy, display, distribute, transfer, link to, reproduce, license, frame, alter, create derivative works of, or republish all or any portion of the Site, the Site content, or any other materials received from or originating from Carland Cartography for any purpose without our prior written consent. Other featured words or images used on the Site to identify the source of goods and services are trademarks and service marks owned by Carland Cartography or owned by third parties. You may not use, copy, display, distribute, modify, or reproduce any of the trademarks found on the Site. This includes but not limited to the following: No resale, redistribution, uploading to stock sites, Artificial Intelligence (AI) training, creation of NFT or derivative works permitted.

Unauthorized use of our intellectual property is strictly prohibited.

11. Limitation of Liability & Indemnification

Carland Cartography shall not be liable for any indirect, incidental, or consequential damages arising from the use or misuse of purchased products.

Our maximum liability shall not exceed the amount paid for the product.

You agree to indemnify, defend and hold harmless Carland Cartography and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

12. Right to Refuse Service & Termination

We reserve the right to refuse service, cancel orders, or revoke access if we believe these Terms & Conditions have been violated.

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

These Terms & Conditions are governed by the laws of the State of Tennessee, without regard to conflict of law principles.You agree to the personal and exclusive jurisdiction of the courts located within Davidson County, Tennessee. You hereby consent to the exclusive jurisdiction and venue of the State and Federal courts in Davidson County, Tennessee in all disputes arising out of or relating to these Terms of Service, our sites and site information.

We reserve the right to update or modify these Terms & Conditions at any time. Changes will take effect immediately upon posting.You can review the most current version of the Terms of Service at any time at this page.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. Your submission of personal information through the store is governed by our Privacy Policy as well as Shopify’s Privacy Policy.
